The Minutes of the Meeting of the Planning Committee held on 31st July 2007 were received and signed as a correct record.

162. PUBLIC PARTICIPATION

Mr Michael Martyn representing the Newton Abbot Civic Society addressed the Committee on behalf of the Newton Abbot Civic Society regarding the recent Public Inquiry and Appeal Decision on 28 Courtenay Street. Mr Martin summarised the procedure which resulted in permission being granted on appeal for change of use from retail to amusement arcade with ancillary trading facility.

The Committee was in formed that the Civic Society supported the Council’s views expressed on the change of use. However, Mr Martyn questioned: council policy regarding non-retail uses in town centres; what was ‘abnormal’ about the application in question that led the inspector to allow the appeal? Publication and notification of the actual appeal hearing leading to interested parties being unable to attend and give evidence. Mr Martyn concluded his address by requesting the Council to support the Civic Society’s intention to take up the matter of publication and notification of appeal hearings with both the Inspectorate and the Planning Authority.

In response the Chairman explained that details of planning appeals was published on Teignbridge District Council’s website but accepted that not everyone had access to the Internet and even then it was not obvious where the information was located. The Chairman also explained ways in which the percentage of retail/non-retail usage was calculated and that it was his understanding that in this instance the Inspector had agreed that a mix of uses should be allowed. Members expressed considerable sympathy with the points made by Mr Martyn and as a result agreed that the Council would contact the Planning Authority with a view to obtaining clarification on the appeal procedure operated by Teignbridge District Council for discussion at the Committee’s next meeting.

163. DEVON COUNTY COUNCIL APPLICATIONS

The Committee noted that the Chairman of the Planning Committee had responded on the Council’s behalf under delegation ‘no objections’ to an application for Planning (Listed Buildings and Conservation Areas) Act 1990 – Listed Building Consent for the digging of trial pits and bore holes at 6 locations along Teigngrace Causeway at Teigngrace Causeway, Kingsteignton.

The Committee noted a letter from the Service Lead – Planning, Design & Property in respect of application number 07/02428/ADV for four illuminated wooden fascia panels, one non-illuminated wooden fascia panel and one non-illuminated hanging sign at Newfoundland Way for Carpetright plc as follows:-


“This application was submitted following the previous refusal. It represents a considerable reduction in size of the signs and also an improvement in the materials from aluminium to timber. The illumination is external and fixed relatively discreetly along the top of the fascia signs. The projecting sign is on the south western corner of the building and is a considerable distance from the nearest listed building, St Leonard’s Church, with a building lying between.”
