The Minutes of the Meeting of the Planning Committee held on 23rd October 2007 were received and signed as a correct record, subject to the following:-

Bushell - Riverside Works Forde Road
Removal of two pine trees, reduction in lateral crown spread for five other trees for Mr Beasley. The Chairman reported that the application had been approved by Teignbridge District Council but that it was not possible to include the request of the Town Council for remedial works to be included as a condition. The District Council had however written to the applicant referring to the Council’s request. The Chairman proposed wording for a letter from this Council to the applicant requesting the root damaged be repaired.
277. CORRESPONDENCE
Ben Stedham’s Wood - Diversion of Footpath No. 39 Further to minute 262(c)/10/07 the Town Clerk referred to a request for comments on an application to Devon County Council for a Footpath Diversion Order at footpath number 39. The Clerk also reported receipt (via e-mail) of a letter from Three Corner Plantation Ltd, 92 letters and a petition containing 100 signatures all in support of the Diversion Order. He also referred to copy letters from the Newton Abbot Civic Society to Teignbridge District Council and that Council’s response.
Councillor Corney-Walker explained that he had received numerous (in excess of 40) representations against the Diversion Order. He also understood that a petition containing over 700 signatures opposing the Order had been submitted to the County Council, however, he could not substantiate such. He also explained that it had been suggested that the
footpath it was proposed to divert had been in existence since 1840. He had also received representations from residents who had walked the footpath since before the Second World War. Accordingly, he was of the view that the Council should object to the proposed Diversion Order. Councillor Leeper referred to the likelihood of the footpath access to Footpath No. 39 from Fern Road (between numbers 57 and 59 Fern Road) would no longer be available should the footpath be diverted and a fence erected. Councillor Leeper was also of the opinion the Council should oppose the Order.
The Chairman, together with other Members of the Committee expressed the view that this proposed diversion of the footpath was minimal (varying between 3 to 5 metres along its length) and facilitated a managed area of woodland providing increased privacy and security. Therefore as long as there was continued public access to the footpath from Fern Road and to Ben Stedham's Wood as currently existed, and fenced as appropriate, they could see no reason to object.
RESOLVED that Devon County Council be informed that as long as access to the diverted footpath from between numbers 57 and 59 Fern Road is maintained, the diverted footpath maintains the same rights as exist and there is no reduction to public access to Ben Stedham’s Woods from the footpath, Newton Abbot Town Council would have no objections to the Diversion Order.
Councillors D Corney-Walker and Robert Leeper requested that their names be recorded as having voted against the above Resolution.

281. TEIGNBRIDGE DISTRICT COUNCIL DEVELOPMENT CONTROL COMMITTEE MATTERS
(a) 07/ 03652/COU – 17 Bank Street – Change of use from vacant shop to adult gaming centre (amusement centre) and installation of new shopfront. Councillor Corney-Walker reported that although cases were put on behalf of the Town Council to achieve a refusal of the application on the basis of loss of retail use the application was approved. The Committee noted that although there was an acceptance by Members that the 70/30% ratio should apply to individual shopping streets, there was no legislation that supported such a principle. Upon an explanation that a premises licence had yet to be granted, it was agreed that the Clerk would make representations to the District Council Licensing Committee on the matter.
(b) 07/03698/MAJ – 6-7 Forde Park and 18, 20 and 22 Keyberry Park – Various Changes of Use and extensions to nursing home. It was noted that the application had been granted subject to various conditions along the lines suggested by the Town Council.
(c) 07/03621 – Reynell Villa, Shaldon Road – Demolition of dwelling and garage and erection of six flats and one dwelling house and associated works. The Committee noted the application was granted subject to the retention of the stone wall.
