83. MINUTES

The minutes of the meeting of the Planning Committee held on 8th June 2010 were received and signed as a correct record.

Minute 58 – Applications in Neighbouring Parishes - Councillor D Corney-Walker explained at length details of the granting of eight out of ten major applications in Teigngrace and Kingsteignton parishes by the District Council at the special meeting of its Development Control Committee held on 21st June 2010. Members noted that it was most unlikely the applications would be called-in at this stage. It was also noted that details of the applications for the proposed 740 residential dwellings was still to be received and considered.

DEVON COUNTY COUNCIL APPLICATIONS - 10/01836/DCR3 - NEWTON ABBOT/KINGSTEIGNTON/TEIGNGRACE – LAND NORTH OF RIVER TEIGN/GREENHILL WAY/RACECOURSE/HACKNEY MARSHES 2.3KM OF FOOTPATH/CYCLEWAY COMPRISING OF A COMBINATION OF METALLED SURFACE AND TIMBER BOARDWALK (DCC/3075/2010) FOR DEVON COUNTY COUNCIL 

Members gave consideration to application reference DCC/3075/2010 - Cycle Route 9 (Teign Estuary Cycleway/Walkway Section 1) between Greenhill Way, Kingsteignton and Town Quay, Newton Abbot, with links to Passage House Inn and Woodmere Way - Construction of 2.3km of footway/cycleway comprising a combination of metalled surface and timber boardwalk on land north of the River Teign. Construction of a cable stayed foot/cycle bridge across the River Teign at Town Quay linking with Forde Road in the Brunel Industrial Estate, Newton Abbot for Devon County Council.

Members referred to previous discussions where it was suggested that consideration should have been given to the line of the foot/cycle path being on the opposite side of the railway line to that proposed within the application. To date, no formal reason had been given for that alternative not having been chosen. Arising from the proposed route of the foot/cycle path, the Committee was disappointed that lengths of the path would be closed to the public on race days at the Racecourse. Additionally, Members raised the numerous benefits of a (microwave) CCTV camera being mounted on top of the bridge. 

Arising from consideration of the matter it was

RESOLVED that with regard to Application Reference DCC/3075/2010 (10/01836/DCR3) Devon County Council and Teignbridge District Council be informed that Newton Abbot Town Council:-

(a) Wholeheartedly welcomed the application;

(b) Is disappointed sections of the route would be closed during race meetings;

(c) Requests that a (microwave) CCTV camera be fitted to the top of the bridge during construction

(d) Would like to know why the alternative route on the opposite side of the railway line was not considered, therefore removing the issue of (b) above?

89. TEIGNBRIDGE DISTRICT COUNCIL DEVELOPMENT CONTROL COMMITTEE/PLANNING APPLICATIONS AT VARIANCE WITH TOWN COUNCIL’S OBSERVATIONS

Councillor D Corney-Walker reported on the following applications at variance with the Council’s observations:-

(a) 10/00715/MAJ – 60 Bed Hotel and Restaurant at Newton Abbot Racecourse – refused under delegated powers for reasons of design, traffic and pollution. Both Newton Abbot and Kingsteignton Town Councils had supported the applications;

(b)  Newton Abbot Gymnastics Centre, Wharf Road – Application No. 10/01218/VAR. Granted at variance with the Town Councils observations.

91. TREE PRESERVATION ORDERS
 
Under consideration of applications in minute 83 (10), (11) and (12) above, the Committee instructed the Town Clerk to write to Teignbridge District Council to express its dissatisfaction with the information accompanying applications regarding trees. Members were of the view that the information required to be furnished to the Planning Authority and therefore to the Town Council was neither reasonable nor acceptable to allow informed discussion and decision-making. In addition, the information provided on the District Council’s website was considered inadequate and ineffective therefore failing to provide an acceptable service to any user. The Town Council therefore requests the District Council to review these matters and take the necessary action.
